The EFF calls for the immediate release of Commissar Fana Mokoena who has been arrested in Mthatha, held in Madeira Police Station together with 12 other EFF members. Commissar Fana Mokoena was engaged in a protest to stop the King Dalinyebo Municipality from illegally demolishing people’s homes. The municipality was in contravention of a standing court order which barred them from demolishing these ho…mes.
Commissar Fana Mokoena was there to stop our people from being thrown into the streets and out in the cold by the merciless ANC government. Section 26(3) of the Constitution, reads: “No one may be evicted from their homes, or have their homes demolished, without an order of court made after considering all the relevant circumstances. No legislation may permit arbitrary evictions.”
The Prevention of Illegal Eviction from and Unlawful Occupation of Land Act gives effect to these constitutional prescriptions and prohibits any person from being evicted or having their homes demolished without alternative accommodation provided for them by the municipality.
The ANC government has enforced apartheid laws that allowed for eviction of black people without court orders.
We demand the immediate release of all our fighters. It is the municipality that is in flagrant violation of a standing court order and further acting illegally and unconstitutionally.
