Cyril Ramaphosa has thus far proved a surprising President. Many people backed him for the presidency because they believed he was smart, a good negotiator, a seasoned politician and economically savvy. Truth to tell, it was never easy to know whether he was really a good negotiator. He had, after all, led the NUM into its most disastrous strike ever, costing many thousands of its members jobs for no gain at all. And while he was widely celebrated for his role in negotiating the new constitution the fact was that De Klerk had a fixed timetable: he had to have a deal by 1994 when the next election had to take place, while the ANC had no time constraints and just had to hold things up in order to exert unbearable pressure.

The Economic Freedom Fighters said Judge Willie Seriti, who chaired the commission of inquiry into the controversial arms deal and those who appointed him, must be held liable for the costs after his findings were overturned by the high court in Pretoria on Wednesday.

Fair and Equitable Society has observed a worrying trend of the Judiciary ruling on costs against the Public Protector in her personal capacity. This punitive approach is not corrective and has the potential to instil fear in the office of the public protector to investigate and issue reports and findings.

              It is possible that the judiciary is aspiring for a politically stable South Africa and might have identified the person in the office of the Public Protector as the current source of political instability in the country. Even so, the office of the Public Protector must be protected by the courts.

Public Protector Busisiwe Mkhwebane has filed an application to the Constitutional Court for leave to appeal a High Court ruling which suspended the implementation of remedial action against Public Enterprises Minister Pravin Gordhan.

A call for the establishment of a constitutional forum by “Fair and Equitable Society NPC”.

The call is brought about by various troubling events in the country. Some of these events have given us reason to believe that our judiciary may be in danger of infiltration by political agendas.

We call for a pro-active approach to safe guard our constitutional democracy. We call for the Establishment of a constitutional forum.

The challenge we have is that of those that think they own the President and the Secretary General. The very same people that complained about this during the past leadership are repeating this and I am not sure whether they think this is good when it is done by them.
